Term & Conditions<\/h3>\n

Contract<\/span><\/strong><\/h4>\n

Creating the Contract<\/span><\/strong><\/p>\n

No contract shall be deeme<\/span>d <\/span>to be binding and valid until <\/span>Indochina Kite Travel<\/span> has received:<\/span><\/p>\n

(<\/span>i<\/span>) the confirmation confirmed by the Customer and<\/span><\/p>\n

(ii) the required deposit or full payment for the Tour.<\/span><\/p>\n

Termination of the Contract<\/span><\/strong><\/p>\n

Indochina Kite Travel<\/span><\/strong> <\/span>reserves the right to terminate the Contract if the Customer’s behavior, conduct, manner and\/or actions, either prior to or during the Tour, are likely to cause offence to other customers, or endanger the safety, well-being, property and\/or benefits of other customers, <\/span>Indochina Kite Travel<\/span><\/strong> staff and associates, or the Customer himself\/herself. In such cases, full cancellation charges as set out in <\/span>Section 4 below shall apply and<\/span> Indochina Kite Travel<\/span><\/strong> shall have no further liability toward the Customer. If the behavior, conduct, and\/or actions of the Customer cause any damage to the accommodation in which the Customer is staying, or causes the delay or diversion of any means of transportation and\/or the Tour, the Cus<\/span>tomer agrees to fully indemnify<\/span> Indochina Kite Travel<\/span><\/strong> against any claim (incl<\/span>uding legal costs) made against<\/span> Indochina Kite Travel<\/span><\/strong> <\/span>by or on behalf of any relevant third party.<\/span><\/p>\n

Payment<\/span><\/h4>\n

Deposits<\/span><\/strong><\/p>\n

A CASE-<\/span><\/strong>BY-CASE REFUNDABLE<\/strong> deposit of 5<\/span>0% of the total cost of the Tour<\/strong><\/span> (G<\/span><\/strong>IT)<\/strong> and related services is required upon booking confirmation<\/span><\/p>\n

A deposit of 5<\/span>0% of the total cost will be settled <\/span>upon confirmation<\/span><\/p>\n

Full Payment<\/span><\/strong><\/p>\n

Full payment for the Tour<\/span> (50%)<\/span> must be<\/span> received no later than Thirty (30)<\/span> days before the Customer\u2019s arrival in our destination.<\/span><\/p>\n

All payments must be made by 1) Credit card, 2) Western Union or 3) <\/strong><\/span>E<\/span><\/strong>lectronic<\/strong> transfer to the appropriate account.<\/span><\/p>\n

Changes to Tour prices<\/span><\/strong><\/h4>\n<\/div>\n<\/div>\n

\n
\n

All prices are quoted in United States Dollars (US$)<\/strong> and are based on transport costs (including the cost of fuel), dues, taxes or fees chargeable at airports and ports, accommodation costs, sightseeing fees and the current appropriate exchange rates at the time of publication. Tour prices may increase or decrease according to any variances in the aforementioned costs and rates. Any such increase\/decrease will be paid by or refunded to the Customer. <\/span> Indochina Kite Travel<\/span><\/strong> will not increase Tour prices less than 30 days prior to the Customer’s arrival date in Vietnam.<\/span><\/p>\n<\/div>\n

Alternatives<\/span><\/strong><\/h4>\n

Whilst <\/span>Indochina Kite Travel<\/span><\/strong> <\/span>will do everything reasonably possible to provide the Customer\u2019s tour itinerary as planned, <\/span>Indochina Kite Travel<\/span> reserves the right to alter itineraries, transport and\/or accommodation if necessary. In such cases, <\/span>Indochina Kite Travel<\/span><\/strong> will notify the Customer of the alterations in writing at least one week prior to the Customer’s arrival in Vietnam.<\/span><\/p>\n

Cancellations<\/span><\/strong><\/h4>\n

Cancellation by <\/span>Indochina Kite Travel<\/span><\/em><\/p>\n

If no deposit is paid, or the Tour is not paid in full by the due date, <\/span>Indochina Kite Travel<\/span><\/strong> reserves t<\/span>he right to cancel the Tour. If<\/span> <\/span>Indochina Kite Travel<\/span><\/strong>, at the request of the Customer<\/strong>, agrees to delay cancellation of the Tour, <\/span> Indochina Kite Travel<\/span><\/strong> has the right to cancel the Tour<\/strong> if the Customer<\/strong> does not pay as agreed in further negotiations and the cancellation charges set out in Clause below will apply and be payable by the Customer.<\/span><\/p>\n

Cancellation by the Customer<\/span><\/strong><\/h4>\n

If the Customer cancels the Tour reservation, the effective date of cancellation will be the date <\/span>Indochina Kite Travel<\/span><\/strong> receives written notification thereof. Customer cancellation charges are listed below.<\/span><\/p>\n

\u00a0– If the Custo<\/span>mer cancels the tour more than 9<\/span>0 days prior to the start date, <\/span>no charge<\/span><\/p>\n

\u00a0– If the Customer cancels the tour <\/span>from 89<\/span> days<\/span> to 3<\/span>0 days<\/span> prior to the start date<\/span>, 2<\/span>0% of the <\/span>total amount will be charged<\/span><\/p>\n

\u00a0– If the Customer cancels the tour <\/span>from 29<\/span> days<\/span> to 15<\/span> days prior to the start date, 5<\/span>0% of the total amount will be charged<\/span><\/p>\n

\u00a0– If the Customer cancels the tour <\/span>from 14<\/span> days<\/span> to 07<\/span> days prior to the start date<\/span>, 8<\/span>0% of the total amount will be charged<\/span><\/p>\n

– If the Customer cancels the tour <\/span>from 06<\/span> days to the start date<\/span>, 10<\/span>0% of the total amount will be charged<\/span><\/p>\n

Note:<\/span><\/strong> Since some suppliers (hotels, cruise companies,<\/span> <\/span>etc<\/span>) have cancellation policies that differ from those of <\/span>Indochina Kite Travel<\/span><\/strong>, the cancellation charge may, at <\/span>Indochina Kite Travel<\/span><\/strong>\u2019s<\/strong> discretion, be adjusted accordingly.<\/span><\/p>\n

Refund for Unused Services<\/span><\/strong><\/h4>\n<\/div>\n<\/div>\n

\n

No refunds or exchanges can be made in respect of accommodation, meals, sightseeing tours, transport or any other services included in the Tour price but not utilized by the Tour member.<\/span><\/p>\n

Force Majeure<\/span><\/strong><\/h4>\n

If, as the consequence of a \u201cForce Majeure\u201d (as defined below), <\/span>Indochina Kite Travel<\/span><\/strong> is obliged to curtail, alter, extend or cancel the Tour<\/strong>, the Customer<\/strong> is not at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of said curtailment, alteration, extension or cancellation of the Tour.<\/span><\/p>\n

\u201cForce Majeure\u201d means “acts of God,” natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle used, or to be used, in connection with the Tour; destruction or damage of accommodation on the Tour<\/strong> not related to the Customer<\/strong> or <\/span>Indochina Kite Travel<\/span><\/strong>; riots, acts of war, civil unrest, and the exercise of legislative, government, municipal military or other authority action; strikes or other industrial actions; the requisition of equipment, mechanical breakdowns, or shortage of fuel; insolvency or default of any carrier or service connected with the Tour, and fraud perpetrated against <\/span> <\/span>Indochina Kite Travel<\/span><\/strong>.<\/span><\/p>\n
